Terms of Service

Last updated: September 12, 2026

1. Purpose

These terms govern access to and use of the CYBERDUR application security testing service, provided by Emmanuel NICOLAS, operating as CYBERDUR (sole trader, SIREN 752 754 192), sold as tests bought singly or in packs, with no subscription.

2. Service description

CYBERDUR performs non-destructive, read-only security tests on the URLs declared by the customer, then provides detailed reports. Each test uses one credit bought by the customer, singly or in a pack.

Raw tool output is automatically correlated into a report, made available to the customer as soon as the test completes.

3. Professional use only

The service is reserved for professionals (legal entities, sole traders, or any entity acting within the scope of their professional activity). It is not intended for consumers within the meaning of French consumer law, whose protective provisions do not apply to these terms.

4. Customer authorisation and responsibility

The customer warrants that they own the systems tested, or are duly mandated by the owner, and hold all necessary authorisations. The authorisation checkbox ticked at sign-up and on each test request constitutes a mandate.

The customer undertakes to submit only URLs they are legally entitled to have tested. CYBERDUR cannot be held liable for an unauthorised submission by the customer, who indemnifies CYBERDUR against any third-party claim resulting from such a submission.

5. Limited warranty

The service is provided "as is". CYBERDUR uses reasonable efforts to identify common vulnerabilities, but does not warrant completeness of detection or the absence of false negatives. A report with no critical finding is not a certificate of absence of vulnerability.

6. Liability cap

To the extent permitted by applicable law, CYBERDUR's total liability under the contract is capped at the amounts actually paid by the customer during the twelve months preceding the triggering event.

CYBERDUR is not liable for indirect damage, loss of business, loss of data or revenue.

7. Prices, credits, billing and no refunds

Tests are sold singly or in packs, at the euro prices shown on the Pricing page on the day of the order. VAT not applicable, art. 293 B of the French Tax Code (CGI).

Payment is a single payment due at the time of order, through our payment provider (Stripe). There is no subscription and no automatic renewal.

Each test purchased (credit) is valid for twelve months from the purchase date and then expires without compensation. Credits are personal and non-transferable.

Purchased credits are non-refundable. A test request cancelled before it starts, or left without domain verification for 30 days, is cancelled and the corresponding credit is returned to the customer's account.

8. Personal data

The processing of personal data is described in the Privacy Policy.

9. Governing law and jurisdiction

These Terms are governed by French law. Any dispute regarding their validity, interpretation or performance that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the Commercial Court (Tribunal de Commerce) of Clermont-Ferrand, including in the event of multiple defendants or third-party proceedings.
